Weekly Classification Question - August 8, 2011


It’s time to get ready for the October 2011 Customs Broker Exam!  Each week, we’ll post a classification question designed to give you practice classifying a question similar to what you might experience on the exam.  Whether or not you plan to take the exam, take the challenge and see if you can answer the weekly question correctly.

There are several differences between classification for the exam and in the normal course of business. One difference is that the correct answer is provided on the exam.  In real life, the answer is not provided in the form of a multiple-choice answer.  You must research rulings, the HTSUS, CBP publications, drawings and other literature to determine the correct classification.  You may need to request a binding ruling from CBP in order to be confident that you have the correct classification.  You don’t have time or resources to do these things during the exam.  Time is another important difference.  You can spend as much time as you want classifying when in the office, but the exam is only four hours long, so you should average three minutes per question.   Classification that might take you an hour or so to research in the office is limited on the exam.  Another difference is that the classification questions on the exam are usually complicated and several possible correct answers have been included to tempt the examinee.

Classify an adult size unisex warrior costume consisting of a 100 percent polyester knit fabric.  The costume includes a pullover top, pants and a wig.  The top features feathers that are sewn on as decoration.  The pants do not contain a fly, but have an elasticized waistband.  The elastic in the pants consists of less than 5% of the weight.  The top is not made as well as the pants; however, the pants are durable in construction.
